NP Islam Ganie, FNP-BC, PMHNP-BC, APRN

NP Islam Ganie is a nightmare to deal with. After twenty sessions he's repeatedly refused to release my records to me electronically and now even refuses to send them to my psychiatrist for continuity of care. I have text message proof of both this and other ethics violations like coercing patients to return dispensed medication to him for alleged "disposal." Below is the formal complaint I submitted to the Board of Nursing along with text evidence proof. Patient Abandonment, Information Blocking (21st Century Cures Act Violation), and Coercive Retaliation To the Board/Investigator: I am formally reporting Islam Ganie, PMHNP, for a pattern of unethical conduct that endangers patient safety, violates federal information blocking laws, and utilizes coercion to retain control over patients who attempt to transfer care. 1. FEDERAL VIOLATION: Information Blocking & Refusal to Transfer Records Despite my formal termination of care and clear requests for continuity of care, Mr. Ganie has… engaged in "Information Blocking" by repeatedly refusing to transfer my medical records to my new provider. The Incident: I have submitted requests via email, text, and voicemail asking him to forward my medical notes to my new psychiatrist, including a signed HIPAA release authorization. The Violation: Mr. Ganie has denied these requests without a valid legal basis. Statutory Breaches: This conduct violates HIPAA (45 CFR § 164.524), which mandates the transfer of PHI to a designated third party. It also violates the 21st Century Cures Act, which prohibits healthcare providers from interfering with the access, exchange, or use of electronic health information. Florida Law: This violates Florida Statute § 456.057, which requires practitioners to furnish copies of reports in a timely manner. By refusing electronic transfer and forcing in-person interaction during restricted hours, he has created an illegal barrier to access. 2. UNETHICAL COERCION: Improper Demands for Medication "Returns" Mr. Ganie threatened to "permanently discharge" (abandon) me if I did not physically return medications I had already dispensed from a pharmacy back to his office for "disposal." The Threat: As documented in text messages, he stated: "You were informed that... failing to comply... would result in permanent discharge from the program if the detox medications are not returned to the office for appropriate disposal." Irregularity: Once a controlled substance is dispensed to a patient, it is the patient's property. It is highly irregular and potentially violates DEA Regulations (21 CFR Part 1317) for an individual practitioner to demand physical possession of dispensed controlled substances, as this breaks the chain of custody. Coercion: Conditioning my status as a patient on complying with this irregular "return" policy - after the medication was already paid for and dispensed - is a coercive tactic used to intimidate rather than treat.

Been seeing Islam for a bit now and he really cares about me being better. Inside and out. Its what i needed.
