There are no words to describe the emotional trauma I’ve experienced due to this surgeon! My mother died due to her neglect at UofR.
These are the alternatives the doctors had a duty to offer Mommy after a failed back surgery per NYS LAW!
Pain pumps
Pain reprocessing therapy
Radiofrequency ablation
Nerve blocks
Transcutaneous electrical nerve stimulation
Spinal cord stimulation
In New York State, if a surgery fails, a doctor has a legal duty to discuss and offer alternative treatment options to a patient, as part of the standard of care, which includes informing the patient of recognized possible alternative forms of treatment and their associated risks and benefits!
After I begged this doctor for an epidural, she only offered it as an outpatient and totally neglected the fact mommy was an inpatient suffering every moment! After my mother displayed trauma and ptsd after the failed surgery, this doctor refused to do additional tests, or consult with a nerve damage specialist, instead… the entire hospital watched my mother suffer while leaving her in the hands of inexperienced residents! Mommy had just got a new kidney 4 years ago with a life expectancy of at least 10 years, but due to the pain, infections, prolonged periods, she lost her mind and their neglect caused her death! My mother was never in jeopardy of dying, why would they offer an epidural as outpatient if my mother was so poorly health bound?
There was no evidence mommy was in danger of dying but she laid as though she was paralyzed in excruciating agony for 2 weeks of delay before they even touched her! My mother had a successful back surgery just a year before, and she was a kidney transplant patient then yet her surgery was impeccable with No issues! I requested many times to get my mother back to the first surgeon, but they refused, saying that they could not do a transfer of care, they procrastinated until she started deconditioning! Instead of offering my mother an alternative to the failed surgery, they discharged her with a swollen fistula arm to a rehab, where she couldn’t sit, stand, walk or even turn her own body from side to side, or use any PT equipment as her arm was swollen from the neck to her finger tip, she couldn’t grip anything, preventing any hopes of therapy! This doctor said she explained the risks of infection! So why did she and other residents not take precautions after the failed surgery and treat her with antibiotics, instead they discharged her to SNF, only to be re-admitted with 7 days, as I was trying to get her on a plane away from WNY region. They said staph and sepsis was seen but it was only from contaminated cultures, due to mommy so called history they were worried about , they had a moral, ethical , and medical obligation to test for the validity of present evidence. Even upon her re-admitting to this surgeon and hospital, her arm stayed swollen 6 more weeks, still begging then to tell us why her arm was swollen for past 4 months as an inpatient ——they said it was just due to no movement but in reality it was blocked veins! Finally, I authorized IR to do a CT with contrast, however, they performed the same CT scans , never did her surgery to correct it, I had to discharge her home to get another hospital to take care of her but her overall was too late. Today, is the anniversary of another hospital and doctors who tried to save her, called me and said, she had been de-conditioned so badly and so long—her nerves are severely damaged, she won’t make it through any failed surgery options! Mommy died when she didn’t have to if they would have simply taken her severe pain to heart, offer an alternative and not focus so much on other patients who don’t look like us, and most of all not discharged her to a SNF prematurely, she would still be here! Although , I haven’t slept this past year, I truly hope this horrific experience that led to mommy’s death be a lesson for just one person! I’m devastated as though it just happened yesterday
