I would say if you need FMLA. Papers filled out be prepared for them not to do it until day of surgery. If you have not been working due to your problem your having surgery on. Your job and benefits are not protected until that day of surgery. The FMLA ( family Medical leave act) is between you and your employer not with the doctor so I have no idea why he thinks he is the gait keeper on this

this is the first surgeon i have seen that when offering his reading of my mri&xrays, left the examining room to discuss the findings of those pictures and when returning to the examining room, NEVER brought either the x-rays, or MRI to go over with me and explain the diagnosis with me. in my next visit, i will demand to see the results of those tests and exactly what the diagnosis is!
